1. Use of the Platform

Dietetix is a clinical nutrition platform designed to support healthcare professionals with calculations, documentation, and workflow efficiency. It is intended for professional use only. It is not intended for consumer or patient-directed use, and should not be used by individuals without appropriate clinical training or expertise.

2. Not Medical Advice

Dietetix does not provide medical advice, diagnosis, or treatment for any health condition. All outputs are provided for informational, educational, and workflow-support purposes only.

Dietetix is not intended for emergency or time-critical clinical decision-making.

Users must independently verify all calculations and ensure alignment with institutional protocols, clinical guidelines, and professional judgment.

While we strive for accuracy, Dietetix does not guarantee that calculations, recommendations, or outputs are free from errors, omissions, or inaccuracies.

3. Clinical Data Responsibility

Users must not enter protected health information (PHI) or personally identifiable patient data into the platform.

Dietetix is not designed to store or process PHI, is not a medical record system, and should not be considered a HIPAA-compliant system.

4. Plans and Access

Dietetix offers multiple access levels, which may include free, paid (Pro), lifetime, beta, or promotional (comped) plans. Features and access may vary depending on your plan.

We reserve the right to modify plan features, limits, or availability at any time.

5. Payments and Subscriptions

Paid plans may be billed on a recurring basis. Payments are processed through third-party providers, including Stripe.

Subscriptions may automatically renew unless canceled. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period unless otherwise specified.

You will continue to have access to paid features until the end of your billing period. No partial refunds are provided unless required by law. Yearly subscriptions may be eligible for a prorated refund if canceled within the first 14 days of the billing cycle.

If a yearly subscription is canceled within the eligible refund period, access will end at the end of the month in which the subscription was canceled. If canceled after 14 days, access will continue until the end of the billing period and no refund will be issued.

Dietetix is not responsible for any fees, charges, or issues related to third-party payment providers. You agree to comply with the terms of service of any third-party payment provider you use.

6. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Each account and subscription is licensed to a single user unless otherwise explicitly authorized by Dietetix in writing. Accounts may not be shared, transferred, resold, or used by multiple individuals. Sharing login credentials or allowing unauthorized access may result in suspension or termination of access.

You must be at least 18 years old to create or use an account.

Access to Dietetix is licensed, not sold. We reserve the right to revoke or limit access to promotional, beta, trial, or complimentary accounts at our discretion.

7. Acceptable Use

You agree not to misuse the platform, attempt unauthorized access, reverse engineer the service, or use Dietetix in a way that could harm users or the platform.

8. Intellectual Property

The Dietetix platform, including its design, calculators, content, branding, and software, is owned by Dietetix and protected by applicable intellectual property laws.

9. Availability and Changes

We may modify or discontinue features at any time and update these Terms as needed.

We do not guarantee uninterrupted or error-free operation of the platform and may perform maintenance, updates, or changes that temporarily affect availability.

10. Termination

We may suspend or terminate accounts for violations of these Terms or misuse of the platform.

11. Limitation of Liability

Dietetix is provided “as is” without warranties of any kind. We are not liable for clinical decisions, patient outcomes, data loss, service interruptions, or any indirect, incidental, special, or consequential damages arising from use of the platform.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Rhode Island, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the use of Dietetix shall be resolved exclusively in the state or federal courts located in Rhode Island unless otherwise required by law.
